Privacy Policy

How Softkrtl collects, uses, shares and protects personal information

Privacy at checkout

We use information needed to process and fulfil an order under contractual and legal bases. We do not ask customers to “consent” to the Privacy Policy as a condition of purchase, and marketing consent is optional and separate.

1. Who this policy applies to

This policy applies to visitors, customers, account holders, reviewers, newsletter subscribers and people who contact Softkrtl.

2. Information we collect

Identity and contact information, including name, billing address, email address, telephone number where supplied and account identifiers.

Order and licence information, including products, licence type, qualifying product, territory, delivery status, licence references and publisher-account details required for fulfilment.

Payment and fraud information received from Stripe, such as payment status, card type, billing checks and risk signals. Softkrtl does not normally receive or store complete card details.

Eligibility evidence for upgrade, crossgrade or education licences, limited to what is reasonably required.

Website, device, cookie, security, support, complaint, review and marketing-preference information.

3. How we obtain information

Directly from you through checkout, account registration, support, review, newsletter and eligibility forms.

From Stripe, authorised publishers, distributors, fulfilment providers and fraud-prevention or security services.

Automatically through necessary website technologies and, where permitted, analytics or marketing technologies.

4. How and why we use information

To create and manage accounts, process payments, accept and fulfil orders, deliver licences, verify eligibility and provide support under the purchase contract.

To comply with tax, accounting, consumer-protection, fraud-prevention, sanctions and other legal obligations.

To protect Softkrtl, customers, publishers and distributors from fraud, misuse and security threats based on legitimate interests and legal obligations.

To improve products, website performance and customer service where our legitimate interests are not overridden by your rights.

To send electronic marketing where we have valid consent or another lawful permission under the electronic-marketing rules.

5. Consent, checkout and marketing choices

We do not rely on consent to process information that is necessary to take payment, fulfil an order, provide support, comply with law or protect against fraud. The checkout therefore links to this policy but does not require a mandatory “I agree to the Privacy Policy” checkbox.

Where we ask for marketing consent, the choice is optional, specific, separate from the purchase terms and not preselected. Refusing marketing does not affect your ability to buy.

You can withdraw marketing consent at any time using the unsubscribe link or by contacting support@softkrtl.com. We keep a minimal suppression record so that we can honour the opt-out.

Cookie and tracking choices are managed through the Cookie Settings panel and are explained in the Cookie Policy.

6. Why some information is required

We need certain identity, contact, payment and order information to enter into and perform a purchase contract. If it is not provided, we may be unable to accept or fulfil the order.

Eligibility evidence is required only if you choose a restricted upgrade, crossgrade or educational licence. Without sufficient evidence, the order may be cancelled.

7. Sharing personal information

We may share information with Stripe for payment and fraud checks; authorised publishers, distributors and fulfilment providers for delivery, registration and eligibility; and hosting, email, support, analytics, consent-management, security, professional-adviser and regulatory recipients where necessary.

We share only what is reasonably necessary and use appropriate contractual and security measures.

We do not sell personal information to advertisers.

8. International transfers

Some providers, publishers or distributors may process information outside the UK. Where UK law requires safeguards, we use an adequacy regulation, the UK International Data Transfer Agreement, the UK Addendum to approved contractual clauses or another lawful safeguard.

9. Retention

Orders, invoices and tax records are generally retained for six years after the end of the relevant accounting period, or longer where legally required.

Account information is normally kept while the account is active and for a limited period after closure, subject to records that must be retained longer.

Support and complaint records are normally retained for three years after closure, or longer where a dispute or legal claim requires it.

Upgrade or education eligibility evidence is normally deleted or minimised within 90 days after verification unless a dispute, fraud investigation or publisher requirement justifies longer retention.

Security and website logs, fraud records, review moderation records and marketing preferences are kept for periods proportionate to their purpose.

10. Security

We use organisational and technical measures designed to protect information, including access controls, secure payment processing, encryption in transit where appropriate, logging, backups and supplier due diligence.

No system can be guaranteed completely secure. Protect your password and notify us promptly of suspected account misuse.

11. Your rights

Depending on the circumstances, you may have rights to be informed, access information, correct inaccuracies, request deletion, restrict or object to processing, receive portable information, withdraw consent and obtain safeguards relating to certain automated decisions.

Rights are not absolute. We may verify identity and retain information where a legal exception applies. Email support@softkrtl.com to exercise a right. We normally respond within one month, subject to lawful extensions.

12. Automated tools and fraud prevention

Stripe and security tools may use automated signals to flag transactions for review. We use these tools to protect customers and Softkrtl from fraud.

We do not intend to make decisions based solely on automated processing that produce legal or similarly significant effects without a lawful basis and appropriate safeguards.

13. Cookies and similar technologies

The Cookie Policy explains the technologies used and how to manage them. Non-essential technologies are not enabled before valid consent unless a specific legal exception applies.

14. Children

The website and products are intended for adults. Customers must be at least 18 to place an order. We do not knowingly collect personal information from children under 13.

15. Data protection complaints

Email support@softkrtl.com and identify the issue as a data protection complaint. We will investigate without undue delay and notify you of the outcome.

You may also complain to the Information Commissioner’s Office. We ask that you contact us first so that we have an opportunity to resolve the issue.

16. Changes and contact details

We may update this policy when our services, suppliers or legal obligations change. Material changes will be brought to your attention where appropriate.
